1. Acceptance of Terms

By accessing and using NC Tax Foreclosure Tracker ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

NC Tax Foreclosure Tracker provides a subscription-based platform for tracking tax foreclosure properties in North Carolina. The Service includes:

  • Access to property listings from multiple North Carolina counties
  • Property search and filtering tools
  • Investment analysis calculators
  • Property tracking and favorites
  • Email notifications and alerts (for paid subscribers)

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Billing

4.1 Free Trial

New users receive a 7-day free trial. Your payment method will be charged automatically at the end of the trial period unless you cancel before the trial ends.

4.2 Subscription Plans

  • Standard Plan: $49/month

4.3 Billing

Subscriptions are billed monthly in advance. All fees are non-refundable except as required by law or as explicitly stated in our Refund Policy. We use Stripe for payment processing and do not store your credit card information.

4.4 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Founding Members are guaranteed their locked-in rate for the lifetime of their subscription.

5. Cancellation and Termination

5.1 Your Right to Cancel

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the paid period.

5.2 Our Right to Terminate

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent activity
  • Use the Service for illegal purposes
  • Abuse or misuse the Service

6. Use of Service

6.1 Permitted Use

You may use the Service for lawful purposes related to researching and tracking tax foreclosure properties in North Carolina.

6.2 Prohibited Use

You agree NOT to:

  • Scrape, copy, or redistribute property data without permission
  • Use automated systems to access the Service excessively
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to harass, abuse, or harm others
  • Impersonate any person or entity
  • Share your account credentials with others

7. Data Accuracy and Disclaimer

IMPORTANT: Property information is aggregated from public sources and third-party providers. While we strive for accuracy:

  • We do not guarantee the accuracy, completeness, or timeliness of property data
  • Property information may be outdated or incorrect
  • You must verify all information independently before making investment decisions
  • We are not responsible for errors or omissions in property data

8. No Investment Advice

The Service provides information and tools but does NOT provide:

  • Legal advice
  • Financial advice
  • Investment recommendations
  • Real estate brokerage services

You should consult with qualified professionals (attorneys, financial advisors, real estate agents) before making any investment decisions.

9. Intellectual Property

The Service, including its design, features, and content (excluding public property data), is owned by NC Tax Foreclosure Tracker and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
  • WE ARE NOT RESPONSIBLE FOR INVESTMENT LOSSES OR MISSED OPPORTUNITIES

11. Indemnification

You agree to indemnify and hold harmless NC Tax Foreclosure Tracker, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in North Carolina, except that either party may seek injunctive relief in court.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
